What to Do if You Have Been in a Work Accident

Go see a doctor. Even if your boss tells you that you are all right and simply need to take off a couple of days, it is important to have a physician examine you in case your condition worsens. Make sure you tell your doctor that the incident leading to the injury took place at work. You are entitled to see your family doctor. Fill out an accident report. If possible, take pictures of the accident scene with a cell phone camera and ask witnesses to make statements. Call The Tadda Law Firm today.

Addressing Workers’ Comp Issues Effectively

We have experience handling workers’ compensation issues for clients throughout Louisiana. We have seen neck and back injuries, as well as knee and shoulder injuries resulting from slip-and-falls, industrial accidents, offshore incidents, and chemical plant and construction site accidents.

We also assist clients in receiving temporary and permanent disability as well as compensation for vocational rehabilitation in cases where workers can no longer perform their usual tasks. In addition to Social Security Disability, we can also address how your workers’ comp claim will affect your Medicare or other benefits.

Scaffolding Falls and Collapses

Scaffolds are used to build and maintain solid structures, but they are far from solid themselves. They are temporary and do not always sit on very solid ground.

A wide variety of serious accidents occur, injuring workers on or under scaffolding:

  • Scaffolding collapses under workers, dropping them from great heights.
  • Moving or falling objects, and even wind, can knock workers off scaffolding.
  • Unsteady scaffolding contributes to objects falling onto workers below.

Although state and federal regulations may dictate the specifications and use of scaffolding, various defects are common. These include faulty design, faulty metal and wood used, poor maintenance and decay, improper assembly, overuse, and overloading.

Millwrights, welders, pipefitters, and anyone needed to build and maintain commercial or residential job sites or industrial plants may suffer broken bones, head or neck injury, and even death in these accidents. If you have lost a family member to an accident, a wrongful death action may bring you needed compensation, with or without a trial.

Although workers’ compensation may restrict your legal actions, a third party who is not your employer can be found liable and provide money in addition to workers’ compensation payments.

Understanding Workers’ Compensation Benefits

Your workers’ comp benefits will include two-thirds of your average weekly wage (subject to a maximum amount). Benefits are due on the fourteenth day after your injury. No wage benefits are due for the first seven days, but if the injury keeps you out of work for over two weeks, you will get your first week’s wages after this time. Everyone’s situation is different.
