Worker's Compensation - Work Related Injuries

Workers' compensation benefits are available to nearly all Louisiana employees who have been injured while on the job.

When you are hurt or injured while performing your duties as an employee in Louisiana, there is a specialized area of legislation that governs from whom and how much you can recover. The Louisiana Office of Workers' Compensation Administration protects employees who have been injured on the job or contracted a work-related illness. Under state workers compensation laws, employers are required to provide workers compensation insurance coverage to each employee. Work related injuries or illnesses typically covered by workers' compensation laws (also referred to as "work comp" or "workmans comp") include:

  • Carpal tunnel-repetitive trauma injuries
  • Hearing problems
  • Back injuries
  • Work-related emotional problems
  • Work-induced heart attack or stroke
  • Occupational diseases such as asbestosis and dermatitis
  • Disfigurement and scarring of face, neck, or hands
  • Asthma or other work related pulmonary conditions
  • Loss of use of limbs
  • Eye injuries

Workers' compensation differs substantially from other types of injury and death cases, and generally provides coverage for any necessary medical treatment related to the injury or illness and compensation for lost wages. The questions that arise most often in a "work comp" case are:

  • Whether you were an employee at the time of the injury?
  • Was the injury received while you were on the job?
  • Was there an injury?
  • What benefits are you entitled to?
  • Was the injury permanent?
  • Are you entitled to a settlement?
  • Should you accept a settlement?

For answers to these and any of the following frequently asked "workers comp" questions, please contact Baton Rouge Attorney Erik M. Tadda today.

  • The insurance company wants to settle my claim. Do I need a lawyer to settle with them?
  • Do I have to treat with the doctor that my boss chooses for me, or can I see my own doctor?
  • The company doctor says I can go back to my job, but my doctor says I'm still disabled. Do I have to go back to work?
  • If I settle for a lump sum, but still need medical treatment, will my medical treatment be covered after the settlement?
  • My boss said I'm not covered for workers' compensation because I didn't work for the company long enough. Is that true?
  • How can I afford an attorney when my only income is my workers' compensation benefits?
  • When should I hire an attorney?
  • How long after my injury do I have to file my claim?
  • How long can I receive workers' compensation benefits?
  • Can I also receive Social Security disability benefits, or Long-Term Disability benefits, while I'm on Workers' Compensation?
